TERMS & CONDITIONS
· Sunbreakers.com is an internet portal for booking hotels, apartments, hostals, rural hotel and villas and all other associated services in Spain, Portugal and their islands. Sunbreakers.com is owned by Travelbreaks Ltd., registered and based in the UK, with Spanish &British shareholders.
· Sunbreakers.com acts solely as a booking portal for Viajes Cosmelli S.A. (the Travel Agent) and your contract will be with the Travel Agent and his appointed agents throught the region.
· Viajes Cosmelli S.A. is one of the longest established travel agents in the region, established in 1959 in Majorca and fully incorporated and bonded in accordance with Spanish law with registration number BAL 03.
· Viajes Cosmelli S.A. guarantee to having secured formal binding contracts with all accommodations featured on the sunbreakers.com website.

CONFIRMING YOUR BOOKING & PAYMENT
· To enter into a contract you must be at least 18 years old.
· Your booking is confirmed as soon as your 15% deposit payment is received by Viajes Cosmelli.
· Your deposit payment and indeed final payment will be transmitted electonically via a secure line into the account of Viajes Cosmelli S.A. at the Banca March, Palma de Mallorca, Spain, (Visit their site at www.bancamarch.com), one of the islands' longest established banks.
· Payment to your accommodation is made by Viajes Cosmelli S.A. through formal contractual agreements and are at all times resposible in law for delivering the service you have booked and paid for.
· A complete description of all the services you have ordered will appear on your confirmation and will illustrate your deposit payment and the amount due. Please check this information carefully and in the event of any concerns, please call Booking in Palma on 0034971 706107 or email him on info@sunbreakers.com
· To ensure complete security for your funds with sunbreakers.com and allowing you to book with confidence, all financial transactions are protected by 128-bits Secure Socket Layer (SSL) protocol in the Banca March systems. To guarantee the identifty of the server, Banca March has a digital certification from Verisign.
· Your final payment must be made at leat 21 days prior to arrival, and although we will alert you electronically, prior to the balance due date, we cannot be held responsible for late or non payment of the balance and in this case the deposit would be forfeit and the booking automatically cancelled.
· Cancellations can be viewed under the heading “cancellations”.
· Please be aware that prices are quoted in euros and sterling. Generally speaking sterling transactions are debited at the amount shown on the confirmation. However, some credit card companies and indeed banks may well make a small surcharge for a sterling payment, that would be debited to your account. You have however our assurance and guarantee that only the amount described on your invoice will be received by your travel provider.

ACCOMMODATION DESCRIPTION & RATINGS
· Sunbreakers.com has made every effort to ensure that the accommodation as well as other details on the website are accurately described. However, as booking agents, we cannot be held responsible for inaccuracies or omissions, or the temporary unavailability of services caused by operational problems.
· Star or Key ratings for all accommodation on the website are those accredited under a formal Spanish or Portugese rating system.
· Viajes Cosmelli S.A., confirms that all licensed property contained in this website and formally contracted to them, confirms with all local and national laws in relation to health and safety. CANCELLATIONS
· Advice of cancellation must be forwarded to us by email as highlighted on the website for the attention of Booking, email address info@sunbreakers.com, quoting the booking reference, and the name of the individual that appears on the invoice.
· The following cancellation charges will apply:-
· Cancellation at any time after booking and 21 days before arrival – 15% of the booking value (the deposit) Within 20 days prior to arrival – 35% of the booking value Within 7 days before arrival – 60% of the booking value Within 24 hrs before arrival – 100% of the booking value
· Should there be any alteration to your travel details, please communicate these to Viajes Cosmelli S.A. for the attention of Booking email info@sunbreakers.com or by phone on 0034971 706107 quoting your reference number.

CHANGES TO YOUR BOOKING
· Viajes Cosmelli S.A. will do everything in its power to ensure that once your booking is confirmed, it is not changed in any way unless requested by yourself
· In the unlikely event the confirmed accommodation you have booked and paid for becomes unavailable, you will be entitled to a full refund. Alternatively you may want to consider alternative available properties at the same cost. In this case if you accepted the alternative at the same cost there would be no refund. If however you accepted a cheaper alternative, we would refund you the difference.. Should the alternative be more expensive than the original booking, then you may be asked to pay a supplement.
· Should you wish to make a booking change, we will do our best to accommodate the request. This should be directed by email to Viajes Cosmelli S.A. for the attention of (Booking info@sunbreakers.com) · An administration of e20 will be charged.

CUSTOMER COMPLAINTS
· Should you have a complaint regarding the services you have received from us, please direct it in writing to :- The Managing Director, Viajes Cosmelli S.A. Calle de Ter 27-3 Poligono Son Fuster 07009 Palma de Mallorca Spain
· Should you have a complaint about your accommodation, please communicate directly with the property owner/manager in the first instance as failure to follow this procedure may compromise your ability to gain future compensation.
· Should the issue not be resolved to your entire satisfaction in a timely way please call Booking at Viajes Cosmelli S.A. who will take this matter up on your behalf, and attempt to resolve the issue to your satisfaction.

OUR OBLIGATION TO YOU
· Sunbreakers.com acts in the capacity of booking agent and as such cannot be held responsible for any death, injury or illness arising out of your stay at the accommodation you have booked through us.
· Any claims for injury, illness or death which are shown to be the proven fault of the accommodation owner/manager, should be pursued against them, in the country of jurisdiction.
· Additionally neither Sunbreakers.com, nor Travelbreaks Ltd, nor the accommodation owner, nor the agent Viajes Cosmelli S.A. and its representatives, will accept responsibility for any loss, delay, damage or inconvenience or any circumstances outside our control or influence.
· These circumstances could include but are not limited to the following :-war or threat of war, civil strife, acts of terrorism, industrial disputes, disasters of any kind, global or national epidemics, fire, severe weather, earthquakes, strikes, closure of facilities to include among others, utilities, airports, ground transportation, action by local by local or national government bodies as well as “acts of God”.
· We reserve the right to change or amend these terms.

OTHER
· "Please be aware that your payment will be collected in euros and the values you can display in other currencies are only indicative of current exchange rates that are liable to fluctuate. We do however guarantee that your payment in euros is exactly the same as the amount received by your travel provider.
Please also be aware that your credit card provider may also make a charge that is also out of our control."

· Only the individuals named on the confirmation will be allowe access to accommodation and will be responsible to the accommodation owner for any extras incurred, as well as compensation for damage that might occur from time to time during the stay.
· At the time of travel, it is the responsibility of the individual to ensure that they have the correct travel documentation in their posession, including booking confirmations, papers, and where appropriate, driving licences, and personal identification.
· It is highly recommended that all individuals travelling take out appropriate travel insurance to cover cancellation, third party and medical charges etc.
